DMCA / Copyright Policy

1. Policy

Effective date: August 29, 2026. Fantelle respects the intellectual property rights of others and expects creators and users of fantelle.com to do the same. We respond to copyright infringement notices consistent with the Digital Millennium Copyright Act (17 U.S.C. § 512) and will remove or disable access to allegedly infringing material expeditiously upon receipt of a valid notice.

2. Filing an Infringement Notice

If you believe content on the Platform infringes your copyright, send a written notice to our designated agent at [email protected] (subject line: DMCA Notice) or via the support form at /support/. To be valid, your notice must include:

  • Identification of the copyrighted work you claim is infringed (or a representative list if multiple works are covered);
  • The URL(s) on fantelle.com where the infringing material is located, precise enough for us to find it;
  • Your contact information: full name, mailing address, and email address;
  • A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law;
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf;
  • Your physical or electronic signature.

Incomplete notices may not be actionable. Do not use this process for non-copyright complaints; those go through regular support.

3. Our Response

Upon receiving a valid notice we will remove or disable access to the identified material, notify the creator who posted it, and record the complaint against their account.

4. Counter-Notice

If your content was removed and you believe the removal was a mistake or misidentification, you may send a counter-notice to [email protected] containing:

  • Identification of the removed material and the URL where it appeared before removal;
  • A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification;
  • Your name, mailing address, and phone number;
  • A statement that you consent to the jurisdiction of the federal district court for your judicial district (or, if outside the United States, any judicial district in which Fantelle may be found) and that you will accept service of process from the original complainant or their agent;
  • Your physical or electronic signature.

We will forward the counter-notice to the original complainant. Unless they notify us within 10 business days that they have filed a court action seeking to restrain the alleged infringement, we may restore the material within 10 to 14 business days of receiving the counter-notice.

5. Repeat Infringers

We maintain a repeat-infringer policy: accounts that accumulate multiple substantiated infringement complaints will be terminated. We may also terminate on a first offence in cases of clear, wilful infringement.

6. Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys' fees. Do not file false notices or counter-notices.
